Accommodation Clause
Article 1 (Scope of Application)
- Contracts for accommodation and related contracts concluded between the inn and guests shall be based on the provisions of these terms, and matters not stipulated in these terms shall be governed by laws or generally established customs.
- In the event that the inn agrees in accordance with the special agreement within the scope not contrary to laws and customs, the special agreement shall take precedence over the provisions of the preceding paragraph.
Article 2 (Application for Accommodation Contract)
Persons wishing to apply for an accommodation contract with the inn shall provide the following information to the inn.
- Guest name
- Date of stay and expected time of arrival
- Accommodation fee (principally based on the basic accommodation fee in Separate Table 1.)
- Age category of cohabitants (adults, children, infants)
- Other matters deemed necessary by the inn
Article 3 (User Registration)
- On the day of use, guests shall register the following information in the inn's check-in system.
- Guest's name, address, age, telephone number, gender, occupation
- For foreign guests who do not have an address in Japan, nationality and passport number (a copy of the passport will be taken).
- Other matters deemed necessary by the inn
- When the guest intends to make the payment of the accommodation fee specified in Article 12 by means of traveler's checks, accommodation vouchers, credit cards, or other currency replacement methods, please present them at the time of registration.
- If the guest is a minor, the guest cannot stay alone.
Article 4 (Conclusion of Accommodation Contract, etc.)
- The accommodation contract shall be deemed to have been concluded when the inn accepts the application under Article 12. However, this is not the case when the inn proves that it did not accept the application.
- When the accommodation contract is concluded under the provisions of the preceding paragraph, the guest shall pay the application fee specified by the inn, limited to the basic accommodation fee for the accommodation period (up to 13 days if it exceeds 13 days), by the date specified by the inn.
- The application fee shall first be applied to the accommodation fee that the guest is ultimately required to pay, and in the event that the provisions of Article 17 and Article 17 apply, it shall be applied in the order of the penalty and then the compensation, and if there is a balance, it shall be refunded when paying the fee under Article 12 as stipulated in the preceding paragraph.
- If the guest does not pay the application fee specified in Paragraph 12 by the date specified by the inn under the provisions of the same paragraph, the accommodation contract shall lose its effect. However, this is limited to cases where the inn has notified the guest of the payment due date.
Article 5 (Special Agreement not to Require Payment of Booking Deposit)
Notwithstanding the provisions of Paragraph 12 of the preceding article, the inn may agree to a special agreement not to require payment of the application fee after the conclusion of the contract.
Article 6 (Refusal of Accommodation Contract Conclusion)
- The inn may not enter into an accommodation contract in the following cases.
- When the application for accommodation does not comply with these terms.
- When there is no room availability due to full occupancy.
- If there is a concern that the person who wishes to stay may engage in acts related to accommodation that may violate laws and regulations, public order, or good morals.
- If the person who wishes to stay is recognized to fall under the following items (イ) to (ハ).
イ) Organized crime groups specified in Article 12, Item 12 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 2001) (hereinafter referred to as 'organized crime groups') and organized crime group members specified in Article 12, Item 6 of the same article (hereinafter referred to as 'organized crime group members'), quasi-members of organized crime groups, or other antisocial forces.
ロ) When a corporation or other organization in which organized crime groups or organized crime group members control business activities.
ハ) When there is a person who falls under organized crime group members among the officers of a corporation. - When the person who wishes to stay engages in behavior that causes significant nuisance to other guests.
- When it is clearly recognized that the person who wishes to stay is a carrier of an infectious disease.
- When violent demands or acts beyond a reasonable range are made in relation to accommodation.
- When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable reasons.
- When it falls under the provisions of prefectural ordinances.
Article 7 (Right to Cancel Accommodation by Guest)
- Guests can request to terminate the accommodation contract by notifying the hotel.
- If a guest terminates all or part of the accommodation contract due to reasons attributable to the guest's fault (except when the hotel has specified the payment deadline for the application fee in accordance with the provisions of Article 4, paragraph 2, and the guest terminates the accommodation contract before such payment), the hotel will charge a cancellation fee as specified in Schedule 12.
- If a guest fails to arrive by 11:00 PM on the day of accommodation without notifying the hotel, the hotel may consider the accommodation contract as terminated by the guest. (In this case, a cancellation fee as specified in Schedule 12 may be charged.)
Article 8 (Right of Cancellation by the Inn)
- The hotel may terminate the accommodation contract in the following cases.
- When a guest is recognized to have a risk of engaging in acts related to accommodation that may violate laws and regulations, public order, or good morals, or is recognized to have engaged in such acts.
- When a guest falls under items (イ) to (ハ) below.
イ) Organized crime groups, organized crime group members, quasi-members of organized crime groups, or other antisocial forces.
ロ) When organized crime groups or organized crime group members control the business activities of a corporation or other organization.
ハ) When there is a person who falls under organized crime group members among the officers of a corporation. - When a guest engages in behavior that causes significant nuisance to other guests.
- When a guest is clearly recognized as a carrier of an infectious disease.
- When violent demands or acts beyond a reasonable range are made in relation to accommodation.
- When it is impossible to accommodate due to reasons such as force majeure.
- When it falls under the provisions of prefectural ordinances.
- When smoking in the bedroom, mischief to fire-fighting equipment, and other prohibited acts (limited to those necessary for fire prevention) are not followed.
- When smoking is done in places designated as non-smoking, mischief to fire-fighting equipment, or acts that interfere with fire prevention are performed.
- When bringing in the following items into the hotel or attempting to do so.
イ) Unlicensed firearms
ロ) Unlicensed knives and swords
ハ) Items emitting a significant odor
ニ) Items in significantly large quantities
ホ) Items easily ignitable or flammable (such as fireworks, incense, gunpowder, and volatile oils)
ヘ) Animals, insects, and other similar items (for guide dogs, please consult with the hotel in advance at the time of booking the accommodation contract.) - When taking out hotel fixtures or items outside the hotel or attempting to move them to another location within the hotel.
- When attempting to change, modify, or alter the building or facilities.
- When not following the rules of use specified by the hotel.
- If the hotel terminates the accommodation contract based on the provisions of the preceding paragraph, fees for accommodation services not yet received by the guest will not be charged. (In this case, a cancellation fee as specified in Schedule 12 may be charged.)
Article 9 (Use Hours of Guest Rooms)
- The time during which guests can use the hotel's rooms is from 3:00 PM to 11:00 AM the next morning. However, in the case of consecutive stays, guests can use the rooms all day except for the arrival and departure dates.
- Notwithstanding the provisions of the preceding paragraph, the hotel may accommodate the use of rooms outside the hours specified in the same paragraph. In this case, additional charges as follows will be charged.
- Up to 12 hours: 20% of the accommodation fee
- For more than 12 hours: the accommodation fee for one night
- After checking out, if guests use hotel facilities other than guest rooms, such as the front space, for a long period equivalent to accommodation, the hotel may charge an appropriate accommodation fee.
Article 10 (Compliance with Terms of Use)
Guests must follow the rules of use posted by the hotel while in the hotel.
Article 11 (Business Hours)
- The hotel's check-in hours are determined by each reservation website.
- The hotel is generally open year-round. In case of closure or time changes, it will be notified on each reservation website.
- The hotel's front desk is open box24 hours a day. Hours may vary depending on the hotel's situation.
Article 12 (Payment of Fees)
- Fees for accommodation services are displayed on the offficial website.
- But are subject to change betrwithout prior notice.,
- Even if the hotel provides a room to the guest and it becomes available for use, the accommodation fee will be charged if the guest chooses not to stay voluntarily.
Article 13 (Responsibility of the Inn)
The hotel will compensate the guest for damages caused during the performance of the accommodation contract and related contracts or due to their non-performance. However, this does not apply if it is not attributable to the hotel's fault.
Article 14 (Personal Information)
The hotel will handle the personal information of guests acquired during the performance of the accommodation contract and related contracts in accordance with the hotel's privacy policy.https://www.jikuan.com/privacy)に従って取り扱います。
Article 15 (Handling When Providing Contracted Rooms is Not Possible)
- If the hotel cannot provide the guest with the contracted room, the hotel will seek the guest's consent to arrange alternative accommodation under the same conditions as much as possible.
- If, despite the provisions of the preceding paragraph, the hotel cannot arrange alternative accommodation, the hotel will compensate the guest with the penalty amount listed in Schedule 12 and the compensation will be allocated to the damages. However, if there is no reason attributable to the hotel for not providing the room, no compensation will be paid.
Article 16 (Handling of Deposits and Other Items)
The hotel cannot keep the guest's belongings, cash, and valuables.
Article 17 (Storage of Guest Baggage or Belongings)
After the guest has checked out, if the guest's belongings or personal items are left behind and the owner is identified, the hotel will contact the owner and request instructions. However, if there are no instructions from the owner or the owner cannot be identified, the hotel will handle it as follows:
- Valuables (items with a value of 100,000 yen or more, including those specified in the Lost Property Law Enforcement Order): Submit to the nearest police station within 7 days, including the date of discovery.
- Items other than valuables: Process in accordance with the Lost Property Law and other related laws and regulations.
Article 18 (Money and Other Valuables and Guest's Belongings)
- For the storage of money and other valuables, guests must either store them themselves or use the valuables locker (safe) in the hotel. Regardless of the use of the valuables locker (safe), the hotel is not responsible for damages such as loss or damage to money and other valuables, except in cases of intentional or gross negligence.
- Guests are also responsible for managing all other items, including food (including items with expiration dates), clothing, amenities, and any other personal belongings brought into the hotel.
Article 19 (Responsibility for Parking)
When guests use the hotel, the hotel provides a location, and the hotel is not responsible for the management of vehicles. However, in managing the parking lot, if the hotel causes damage intentionally or negligently, it will be liable for compensation.
Article 20 (Responsibility of Guests)
If the hotel incurs damages due to the guest's intentional or negligent actions, the guest will compensate the hotel for the damages.
Article 21 (Use of Internet Communication)
When using the Internet communication service or other means of communication within the hotel through services, guests are responsible for their own use. Regarding the guest's use of Internet communication, if the hotel deems the guest's actions inappropriate and anticipates damages to the hotel and third parties, the hotel may request the cessation of such Internet communication or claim compensation for the damage incurred by the hotel.
Article 22 (Agreements Regarding Room Cleaning)
If a guest uses the same room continuously, the hotel will only perform daily cleaning if the guest stays for four nights or more, starting from the second night. However, cleaning will be performed at a maximum frequency of once every three days, and if a different arrangement is set at the time of reservation, that arrangement will apply. If no specific instructions are given by the guest, the hotel will perform cleaning at intervals deemed necessary for room maintenance and hygiene management, taking into account the spirit of laws and prefectural ordinances. During periods considered unnecessary for cleaning, the hotel will not provide towel and linen exchanges or replenish amenities. Guests cannot refuse the hotel's judgment on the minimum necessary cleaning frequency for room maintenance and hygiene management.
Article 23 (Other)
- If a dispute, accident, or other conflict arises between guests not caused by the hotel's fault, the guests are responsible for resolving it.
- If deemed necessary for the hotel's operation, the hotel may change the contents of this agreement. In such cases, the hotel will provide information at an appropriate time and by appropriate means, taking into account the impact and the operational status of services.
- This agreement is interpreted based on Japanese law. In the event of a lawsuit related to this agreement, the Tokyo District Court shall be the exclusive agreed-upon jurisdiction court for the first instance.
- This agreement is prepared in Japanese and the foreign language designated by the hotel. In case of any inconsistency or discrepancy between this agreement and the translated agreement, the Japanese version will prevail.
